Benefits for Military Families Not Domiciled in Virginia

Under both the Federal Higher Education Opportunity Act of 2008 and 2013 amendments to Virginia Code, certain categories of military related students may qualify for in-state tuition regardless of domicile. Please recognize a domicile decision must be determined prior to consideration under Virginia Code.

Veteran Exception Provision

Veterans residing within the Commonwealth are eligible for the in-state tuition rate under the following provision:

23-7.4:2 H. Notwithstanding any other provision of law, veterans residing within the Commonwealth shall be eligible for in-state tuition charges. Any students granted in-state tuition pursuant to this subsection shall be counted as in-state students for the purpose of determining college admissions, enrollment, and tuition and fee revenue policies.

The veteran must demonstrate physical residency in the Commonwealth of Virginia prior to the first day of the term and must have served and then have separated under conditions other than dishonorable. This provision is reserved for the veteran only.
